Chapter 1 General Rules
Article 1 Definitions
In this Terms of Use Agreement for Okayama Infrastructure Box【Okayama iBox】 (hereinafter referred to as “the Agreement”), the following terms shall have the following meanings:

Data Administrator | "Data Administrator" is the provider of data used to service users via Okayama Infrastructure Box【Okayama iBox】in accordance with the Agreement. |
Provided Data | "Provided Data" means the data that the data administrator provides to service users via Okayama Infrastructure Box【Okayama iBox】. |
Contents | "Contents" means information (data, images, texts, user's manuals, etc.) provided through This Service, including the provided data. |

Article 2 Purpose and Application
- The Agreement stipulates the conditions of use for This Service provided by the Operations Administrator.
- In the Agreement, unless otherwise specified, the name of laws and regulations means that of Japanese laws and regulations.
Article 3 Amendment
- The Operations Administrator may make amendments to the Contents of the Agreement without obtaining the individual approval of users by notifying them in advance of the notice on the amendments, the Contents after the amendments, and the effective date of the change.
- The amended Agreement shall become effective from the time of publication in advance.
- In cases of an amendment to the Agreement, the Operations Administrator shall notify the Service User of the amendment by posting on the website of This Service.
- The Service User shall be deemed to have agreed to apply the amended Agreement when the Service User uses This Service after receiving the notice set forth in the previous item.
Chapter 2 Use of This Service
Article 4 Acceptance of the Agreement
- Service Users shall read the Agreement carefully before using This Service, and shall use same upon agreeing to the Agreement.
- The Service User shall be deemed to have agreed to the Agreement when the Service User uses This Service.
Article 5 Service User Responsibilities
- Prior to the use of Provided Data or distributing data through Data Catalog or API provided by This Service, an account must be issued by the Operations Administrator in advance. The Operations Administrator shall grant privileges and issue accounts to individuals. The person who uses the specific service or provides data shall appropriately manage the issued account.
- Persons wishing to use the specific data through This Service shall enter the required items on the application screen on the website provided by the Operations Administrator and apply for use by submitting said application to the Operations Administrator (hereinafter referred to as the "Application," and the person who submits the Application is referred to as the "Applicant"). The Operations Administrator may reject the Application as a result of the examination thereof in accordance with the designated screening method.
- In the event the Operations Administrator rejects the Application for This Service pursuant to the provisions of the preceding paragraph, the Operations Administrator shall promptly notify such Applicant. The Operations Administrator shall not be obligated to disclose the reason for refusing such Application.
Article 6 Prohibited Matters
The Service User shall not engage in any act falling under any of the following items when using This Service (including the use of secondary products):
- Acts in violation of the Agreement;
- Acts in violation of laws and regulations;
- Acts contrary to public order and morality;
- Acts infringing the rights of third parties;
- Acts that cause disadvantage, damage, or discomfort to the Operations Administrator, other Service Users of This Service, or other third parties;

The following acts related to servers, networks, and other devices constituting This Service:
- Imposing an excessive load;
- Interfering with the specifications or use thereof, such as unauthorized access or cracking;
- Analysis, reverse engineering, or any other acts aimed at obtaining source code;
- Incorporating all or part of the constitution of This Service into other software;
- Inputting invalid data or instructions.
- Any other actions that interfere with or may interfere with the management and operation of This Service.
Article 7 Use of Third Parties
The Service User may not allow any third party to use This Service in whole or in part, whether paid or free (including, but not limited to, directly or indirectly lending its ID, account, password, etc., for the use of This Service, or allowing the use of any service that incorporates This Service).
Article 8 Maintenance, Management, etc. of Information
When using This Service, the Service User shall appropriately manage the account/password issued according to Article 5, Paragraph 2, server facilities, communications facilities, and information/equipment/software/systems that the Service User is required to maintain and manage with respect to This Service. In addition, the Service User shall assume full responsibility for the results of such management (including the results of disclosure, leak, or inference by a third party regarding the account/password issued according to Article 5, Paragraph 2).
The data administrator manages the data provided to This Service at its own responsibility and expense.
Article 9 Use of Data
- Service Users may use Contents which are not set forth in conditions for use under the conditions of use of data (referring to the most recent version at the time of use, hereinafter referred to as “superior terms and conditions, etc.”), etc., regardless of whether they are referred to as related laws and regulations, terms and conditions, agreements, licenses, or other names in accordance with Creative Commons Display 4.0 International (CC BY 4.0 License). In this case, the source shall be listed as "Okayama Infrastructure Box【Okayama iBox】," or "Okayama Infrastructure Box【Okayama iBox】" and "Data Administrator."
- The requirements for the use of some Contents are set forth by Superordinate Agreement. The provisions of the preceding paragraph do not apply to Contents for which the requirements for use are stipulated by related laws and regulations or the Superordinate Agreement. Some Contents for which the Superordinate Agreement is stipulated, directly or indirectly indicate/imply that the conditions for use are stipulated by indicating the source, etc.; however, some do not clearly specify the section including the specified conditions for use. When using This Service, such conditions must be confirmed at the responsibility of the data user.
- All content copyrights and other rights belong to the copyright holder. The Operations Administrator does not assign or grant any rights to the Service User. When using the Contents for which the Superordinate Agreement is stipulated, the Service User shall comply with the provisions of the Superordinate Agreement.
- The Service User shall be liable for compensating any damage caused to the Operations Administrator by the use of the Contents beyond the scope permitted to the data user as set forth in the preceding Paragraph 3 or the infringement of the rights of the Contents as set forth in the preceding paragraph.
Article 10 Consent to the Superordinate Agreement
- In the event that any Superordinate Agreement is stipulated for the Contents, the data user shall be obligated to confirm and comply with such Superordinate Agreement when using such Contents, and the Contents of such Superordinate Agreement shall apply to This Service. In addition, with respect to the use of Contents for which the Superordinate Agreement has been stipulated, the Service User shall be responsible for any violation of the Superordinate Agreement by the Service User, and the Service User shall compensate the Operations Administrator for any damages due to such violation.
- Except as otherwise specified in the Agreement, in the event of any inconsistency or conflict regarding the use of the Contents between the Agreement and the Superordinate Agreement, the provisions of the Superordinate Agreement shall take precedence.
Article 11 Provision of Data
- The data administrator shall present the Service User with the Terms of Use Agreement for the Provided Data.
- The data administrator shall describe in the metadata and present the Service User the information possessed regarding the quality of the Provided Data, such as freshness, granularity, accuracy, and reliability.
- The data administrator shall grant permission for use of the metadata and samples of the Provided Data that have been provided through This Service under the Creative Commons Display 4.0 International (CC BY 4.0 License).
- In the event the data administrator does not explicitly present the Terms of Use Agreement for the Provided Data to the data user, the data administrator shall grant permission for the use of such Provided Data under the Creative Commons Display 4.0 International (CC BY 4.0 License).
Article 12 Intellectual Property Rights
- All intellectual property rights of the tangible and intangible components (software, data, images, text, demonstrations, user manuals, and other Contents) that constitute or are attached to This Service belong to the Operations Administrator or the third party that has granted license for use (hereinafter referred to as the "Licensor" in this Article) to the Operations Administrator.
- The license to use or access This Service under the Usage Contract does not constitute a license to use the intellectual property rights of the Operations Administrator or the Licensor with respect to This Service within the extent necessary for the use of This Service.
Chapter 3 Discontinuation of Provision
Article 13 Discontinuation of Provision
- In the event of a natural disaster, incident, other emergency, serious failure of the service, or other unavoidable circumstances, the Operations Administrator may stop or restrict the use of This Service without prior notice to the Service User.
- In the event of a significant concentration of use of This Service, the Operations Administrator may restrict use of This Service without prior notice to the Service User.
- The Operations Administrator shall post notification of suspension or restriction of provision of This Service on the website of This Service.
- The Operations Administrator is not responsible for any damage incurred by the Service User in the event that the provision of This Service is suspended or restricted in accordance with paragraphs 1 and 2.
Article 14 Termination of Provision
- The Operations Administrator may terminate the provision of This Service by announcing its termination on the website of This Service.
- The Operations Administrator is not responsible for any damage incurred by the Service User in the event that the provision of This Service is terminated in accordance with paragraph 1.
Chapter 4 Disclaimer
Article 15 Non-Warranty, Disclaimer
- The Operations Administrator shall not be liable for any such damage suffered by the Service User or other third parties due to the use or unavailability of This Service.
- The Operations Administrator shall not be liable for any such damage suffered by the Service User or any other third party due to the suspension, discontinuation, interruption or restriction of the use of This Service, or due to problems with the communication line.
- The Operations Administrator shall not be liable for any such damage caused by malware infection or other problems during the use of This Service.
Chapter 5 Miscellaneous Provisions
Article 16 Delegation of Service Operation
- The Operations Administrator may outsource all or part of the operations necessary for the provision of This Service to a third party. In such case, the Operations Administrator shall obligate the outsourcing contractors to assume the obligations equivalent to those of the Operations Administrator stipulated in the Agreement.
Article 17 Protection of Personal Information
- The Operations Administrator shall appropriately handle the personal information of the Service User based on the "Privacy Policy" stipulated on the website provided by the Operations Administrator.
Article 18 Governing Law and Jurisdiction
The formation, interpretation and performance of this Contract shall be governed by the laws and regulations of Japan.
Article 19 Dispute Resolution
- In the event any discrepancy of opinion or recognition or any other dispute arises between the Operations Administrator and Service User with respect to the Usage Contract, the parties concerned shall consult with each other in good faith and endeavor to resolve such dispute.
- Notwithstanding Paragraph 1, where such dispute cannot be settled through consultation, action may be filed under the Code of Civil Procedure (Law No. 29 of 1890) or a petition for mediation may be filed under the Law for Conciliation of Civil Affairs (Law No. 222 of 1951).
- The Operations Administrator and the Service User agree that the court having jurisdiction over the location of the Operations Administrator (the Okayama District Court as of the date of enactment of this provision) shall be the exclusive jurisdictional court of the first instance for any dispute arising out of or relating to the Usage Contract.
Supplementary Provisions
Article 1 Commencement of Application
The Agreement shall come into force on March 24th, 2025.
Upper-level Terms and Conditions for Each Content
The following are the terms and conditions that are stipulated as upper-level terms and conditions for specific content in accordance with Article 10 of the Terms and Conditions of Use.
1. Upper-level rules for observation information
1 Introduction
Observation information published in the “Okayama Infra Box” is intended to be used for research, disaster prevention, etc., using historical statistical data. Data sent from unmanned observation stations are published as is, and may include missing data or abnormal values due to malfunctions of observation equipment, communication anomalies, etc. Please use with caution. Please be careful when using the data.
2 Copyright

2. Superiority rules for flood inundation zones
1 Introduction
The flood inundation zone information published in the “Okayama Infrastructure Box” is based on simulations of areas expected to be flooded in the event of a river overflow and the water depth expected in the event of flooding. The information is based on simulations of the areas that are expected to be inundated in the event of river flooding, and the depth of water that would be expected if the river were to flood.
Due to the revision of the Flood Prevention Law in 2015, the precondition for the designation of flood inundation zones was changed from the previous planned rainfall (planned scale), which was the basis for river maintenance, to the maximum possible rainfall (assumed maximum scale).
With the revision of the Flood Prevention Law in 2021, the rivers for which flood inundation zones are designated now include small and medium-sized rivers that are surrounded by houses or other objects to be protected, in addition to the former rivers for which flood forecasts were made and rivers whose water levels are known to the public.
The maximum possible rainfall is based on the maximum amount of rainfall observed in the past in each of 15 regions with similar rainfall characteristics in Japan.

The information on the assumed flood inundation zones displayed in the “Okayama Infrastructure Box” is not a public notice or a publicly available map. The specific conditions for inundation are different for each river, so please refer to the maps of the flood inundation zones posted on the website of the River Division of the Okayama Prefectural Public Works Department or the Okayama River Office of the Ministry of Land, Infrastructure,Transport and Tourism.The information on the flood inundation zones displayed in the“Okayama Infrastructure Box” is a simulation of the inundation situation that would occur if the subject river were to overflow due to flooding caused by rainfall, taking into account the condition of the river channel and flood control facilities at the time the flood inundation zones were designated. This simulation does not take into account the inundation of rivers other than the subject river (due to its break), inundation due to rainfall exceeding the rainfall assumed in the simulation, inundation due to rainwater runoff and storm surge, etc. Therefore, it is possible that inundation may occur in areas other than the assumed flood inundation area or that the assumed water depth may be higher than the actual inundation depth. Therefore, there may be cases where flooding occurs in areas other than the assumed flood inundation area, or where the assumed flood depth differs from the actual flood depth.
When map information that contains many figures is stacked, it may take some time before it is displayed due to the large amount of data transmission.

3. Superior Rules for Landslide Disaster Prevention Areas and Special Landslide Prevention Areas
1 Introduction
Landslide disaster prevention areas and special landslide prevention areas (hereinafter referred to as “prevention areas, etc.”) are designated by the prefectural government based on the Landslide Disaster Prevention Act enacted in 2001. (hereinafter referred to as “watch areas, etc.”) are areas designated by the prefectural government based on the Landslide Disaster Prevention Act enacted in 2001 to protect the lives and bodies of citizens from landslides by conducting a basic survey and identifying areas where landslides are likely to occur. After the area is designated, the municipality concerned will develop and promote a warning and evacuation system.

4. Superiority Rules for Storm Surge Inundation Assumption Area Map
1 Introduction
Please read the following notes before using the storm surge inundation assumption area map.
2 Notes
This storm surge inundation area map is based on the “Okayama Coastal Storm Surge Inundation Area Map” published by the prefecture in January 2022, and is estimated in units of 10m mesh.
This chart was created based on the “Guide for Creating Assumed Storm Surge Inundation Zones (Ver. 2.10),” and is based on the largest typhoon ever recorded in Japan, and storm surge inundation simulations were conducted using multiple typhoon routes to maximize the tide level deviation (difference between tide level and astronomical tide level) at each coastal point, and the following are the possible The maximum inundation area and depth are shown in the case of the largest possible storm surge inundation.
Since rainfall is expected to occur at the same time as storm surge caused by typhoons, this figure assumes the worst-case scenario and assumes that flooding caused by rainfall of the planned magnitude occurs simultaneously in sections of first-class rivers and some second-class rivers that are clearly affected by storm surge.
Due to local ground irregularities, building shapes, rainwater runoff (internal water), and other factors that are difficult to reproduce in storm surge inundation simulations, inundation may actually occur outside of the assumed inundation area or the inundation depth may be greater than assumed.
The uncolored areas are either “water surfaces of rivers, lakes, marshes, etc.” or “outside the assumed inundation area”.
Topographic data is based on the data surveyed in FY 2014 and FY 2015, and may differ from the current situation.
River cross-sections may differ from the current conditions because they reflect river maintenance up to the end of fiscal year 2016.The height of coastal levees, etc., may differ from the current conditions because the height, etc., is set in consideration of the maintenance status as of the fiscal year 2008.
The storm surge inundation zones are based on current scientific knowledge and past typhoons, and do not guarantee that storm surges of a magnitude exceeding these zones will not occur.
